I have news, good news. We got the pleading filed in time and the eviction hearing has been moved from County Court to District Court. This means nothing is going to happen regarding removing us from the house until we see the judge. The pleading still has to be reviewed to make sure all the conditions of remand are met but we are not expecting any issues. In 30-45 days we will be notified a judge has been assigned. We then get the opportunity to expand the pleading to a full complaint instead of the Cliff Notes edition we filed. We also have an opportunity to add additional defendants. After that, it is responding electronically so I don’t know if we ever actually see a judge since we have no witnesses we are planning to call and the lender has no witnesses.
Right now the legal fund is $625 from Paypal and $4103 (net) from Gofundme for a total of $4728.
Filing Fees. $400
Scanning of exhibits to DVD. $80
Legal advice on how to plead a removal. $200
Total expenses so far. $680 leaving balance of $4048
I am going to have transcript costs to get paperwork for first two bankruptcies but have no idea how much at this point. I don’t expect it to be much.
We did get most of our exhibits scanned as interactive PDF to DVD. Since the case will be handled electronically it will make it so much easier to send evidence, put notes on items and make it easier when we do find an attorney. We are still looking and hoping since the pleading is filed it will be more attractive. The fact we didn’t hit the $5000 needed for the down payment to the original attorney isn’t the end of the world. Actually, it is like a sign we shouldn’t hire someone to represent us in a case to save our house when he thinks we should walk away.
So now we wait and on to happier activities.
